Why do some doctors routinely deny birth control refills without additional tests, and why do some doctors disrespect patient autonomy in decisions about abortions, labor and delivery, organ transplants, and more? This book argues that medical sexism is a major cause of this pervasive mistreatment.

In this paper, I defend an account of the ethics of precision medicine that can explain both its possibilities and limits. Creating a new conceptual and normative model of the ethics of precision health can ensure that good medicine is also excellent and that excellent medicine is also good by providing a resource to scientists and clinicians. First, I propose a new conceptual analysis of precision health. I argue that precision health is defined primarily by targeted medical interventions and not (...) by stratification, as others have asserted. Next, I argue that failure to be adequately responsive to this conceptual analysis explains common ethical abuses in the field. Third, I argue that this conceptual analysis can also pave the way for future research heretofore overlooked. Thus, we can limit abuses in precision health research and care while at the same time opening new avenues to help historically oppressed communities. (shrink)

In Medical Sexism: Contraception Access, Reproductive Medicine, and Health Care, Jill B. Delston uses a feminist lens to examine the overwhelmingly common gynecological practice of declining to write prescriptions for oral contraceptives unless a woman agrees to an annual Pap smear, which is used to detect precancerous changes, as well as cancer of the cervix. Employing a comprehensive evaluation of the medical literature, Delston methodically builds a strong argument that these measures not only do not follow evidence-based (...) medical guidelines, but they also carry a significant potential of harm to the patient. How should we respond to political ambivalence when conflicting avenues for political action arise? Some theories of justice, such as objective theories, tell us to follow whatever norms realize a set of independently determined objective goods. I argue such theories are incomplete because they specify political goods to aim at, but do not specify which norms to follow, and thus yield an ineliminable ambivalence. Through analysis of a series of significant obstacles, I show that the objective goods that theorists defend (...) are multiply realizable and thus that different sets of mutually exclusive norms could successfully bring about such goods. I call this set of obstacles “ambivalence” in objective theories of political norms because we must choose between multiple conflicting would-be norms, each of which is compatible with the theory. Objective theories cannot provide direction on these choices and so international norms of justice raise a question about which ambivalence could be appropriate. How should we solve this ambivalence problem? I consider a range of competing alternatives that could complete objective accounts and show that consent through social contract theory presents the best available alternative. I conclude that avoiding political ambivalence on objective global political norms necessitates a consent-based constructivist element. (shrink)

The role of microaggressions has gained increasing philosophical attention in recent years. However, microaggressions only tell part of the story. An often-overlooked component of inequality is the uneven and unjust distribution of microaffirmations. In this paper, I give a new definition of microaffirmations as signals that a recipient belongs to some valued or high-status class. Microaffirmations can—but need not—lead individuals to gain a sense of confidence, belonging, and merit. I then explain the harms of microaffirmations, arguing that when microaffirmations are (...) distributed inequitably, they can have larger ramifications for injustice, harming some vulnerable groups more than others. In addition, microaffirmations can lead individual actors to make choices based on who gives them microaffirmations and where they receive them, and thus can have outsized influence over the direction of an individual’s life because individuals tend to migrate to where they feel valued, appreciated, and included. I then turn to solutions to the problems I raise. I argue we should attend to and attempt to rectify inequalities in microaffirmations because doing so can help ensure not just the absence of negative attention, but also that the presence of positive attention is flowing in a just and equitable way. In this paper, I argue that virtue ethics is unfortunately committed to a developmentally detrimental form of moral evaluation in its traditional iterations. That is, first, because both action guidance and moral development are central to virtue ethic and, second, because virtue ethics permits or requires character appraisal in moral education and child-rearing through praise and blame. However, studies from developmental and clinical psychology show that praise or blame involving character appraisal can be detrimental to children and, especially, to women (...) and girls. While not all empirical studies point in this direction, the data are sufficiently murky to warrant an objection to virtue ethics along the lines of a situationism. Using a feminist and care-oriented critique, I argue this could pose a problem for virtue ethics. However, I argue that the criterion of moral evaluation can and must be distinguished from successful moral education of children to avoid this problem. By focusing on behavior instead of character, moral agents can avoid the harm virtue ethics may cause. Finally, I respond to an objection that doing so makes virtue ethics esoteric or self-effacing and argue that it fares no worse than other moral theories. (shrink)

What obligations do global actors have to prevent terrorism? Is consent required to create an international obligation, or does the correctness of its goals ground its legitimacy? In this paper, I consider these questions with respect to a subset of international law often overlooked: anti-money laundering and combating the financing of terrorism . AML/CFT comprises peaceful response to violence and terrorism, making it a significant component of international justice and diplomacy. First, I present the current legal framework for AML/CFT institutions (...) and identify two conflicting sources of justification: objective value and consent. The fix for this problem, I argue, does not come from either component alone. Objective value cannot provide the sole source of justification because it cannot settle the choice between multiple competing norms that would achieve the same objective goods were we to follow them . Politicians, employers, courts, and health insurance companies are often discussed as problematically preventing access to birth control. However, doctors have more direct control over women's health and quietly have been much more effective at preventing patients' access to contraception. Obstetrician/Gynecologists routinely deny their patients access to contraception ostensibly in the name of health by withholding birth control until patients undergo yearly pap smears. I argue that those in the medical field are motivated by similarly sexist concerns as those in other (...) major institutions in the United States, but that they are often overlooked in discussions of biomedical ethics. After providing background, I argue that using birth control as a bargaining chip to control patients is morally impermissible, is paternalistic, and is contrary to consent. I next argue that sexism explains, though does not justify, this practice. I discuss the medical harms of routine pap smears and withholding birth control. These claims make medical malpractice likely. Withholding birth control to coerce individuals seeking medical care is medical malpractice, paternalistic, violates autonomy, and is contrary to consent. (shrink)

Sex is a fundamentally important biological variable. Recent years have seen significant progress in the integration of sex in many aspects of basic and clinical research, including analyses of sex differences in brain function. Significant advances in the technology available for studying the endocrine and nervous systems are now coupled with a more sophisticated awareness of the interconnections of these two communication systems of the body. A thorough understanding of the current knowledge, conceptual approaches, methodological capabilities, and challenges is a (...) prerequisite to continued progress in research and therapeutics in this interdisciplinary area. Sex Differences in the Brain provides scientists with the basic tools for investigating sex differences in brain and behavior and insight into areas where important progress in understanding physiologically relevant sex differences has already been made. This book was edited and co-authored by members of the Isis Fund Network on Sex, Gender, Drugs and the Brain, sponsored by the Society for Womens Health Research. The book is arranged in three parts. The Cambridge History of Renaissance Philosophy, published in 1988, offers a balanced and comprehensive account of philosophical thought from the middle of the fourteenth century to the emergence of modern philosophy. This was the first volume in English to synthesise for a wider audience the substantial and sophisticated research now available. The volume is organised by branch of philosophy rather than by individual philosopher or school, and the intention has been to present the internal development of different aspects of the (...) subject in their own historical context. We report the identification of a recurrent, 520-kb 16p12.1 microdeletion associated with childhood developmental delay. The microdeletion was detected in 20 of 11,873 cases compared with 2 of 8,540 controls and replicated in a second series of 22 of 9,254 cases compared with 6 of 6,299 controls. Most deletions were inherited, with carrier parents likely to manifest neuropsychiatric phenotypes compared to non-carrier parents. Probands were more likely to carry an additional large copy-number variant when compared to matched controls. The clinical (...) features of individuals with two mutations were distinct from and/or more severe than those of individuals carrying only the co-occurring mutation. Our data support a two-hit model in which the 16p12.1 microdeletion both predisposes to neuropsychiatric phenotypes as a single event and exacerbates neurodevelopmental phenotypes in association with other large deletions or duplications. Analysis of other microdeletions with variable expressivity indicates that this two-hit model might be more generally applicable to neuropsychiatric disease. © 2010 Nature America, Inc. We often use symmetries to infer outcomes’ probabilities, as when we infer that each side of a fair coin is equally likely to come up on a given toss. Why are these inferences successful? I argue against answering this with an a priori indifference principle. Reasons to reject that principle are familiar, yet instructive. They point to a new, empirical explanation for the success of our probabilistic predictions. This has implications for indifference reasoning in general. I argue that a priori (...) symmetries need never constrain our probability attributions, even when it comes to our initial credences. (shrink)

Pancreatitis is a complex, progressively destructive inflammatory disorder. Alcohol was long thought to be the primary causative agent, but genetic contributions have been of interest since the discovery that rare PRSS1, CFTR and SPINK1 variants were associated with pancreatitis risk. We now report two associations at genome-wide significance identified and replicated at PRSS1-PRSS2 and X-linked CLDN2 through a two-stage genome-wide study. The PRSS1 variant likely affects disease susceptibility by altering expression of the primary trypsinogen gene. The CLDN2 risk allele is (...) associated with atypical localization of claudin-2 in pancreatic acinar cells. The homozygous CLDN2 genotype confers the greatest risk, and its alleles interact with alcohol consumption to amplify risk. This book moves beyond traditional readings of Alexis de Tocqueville and his relevance to contemporary democracy by emphasizing the relationship of his life and work to modern feminist thought. Within the resurgence of political interest in Tocqueville during the past two decades, especially in the United States, there has been significant scholarly attention to the place of gender, race, and colonialism in his work. This is the first edited volume to gather together a range of this creative scholarship. It reveals (...) a tidal shift in the reception history of Tocqueville as a result of his serious engagement by feminist, gender, postcolonial, and critical race theorists. The volume highlights the expressly normative nature of Tocqueville’s project, thus providing an overdue counterweight to the conventional understanding of Tocquevillean America as an actual place in time and history. By reading Tocqueville alongside the writings of early women’s rights activists, ethnologists, critical race theorists, contemporary feminists, neoconservatives, and his French contemporaries, among others, this book produces a variety of Tocquevilles that unsettles the hegemonic view of his work. Seen as a philosophical source and a political authority for modern democracies since the publication of the twin volumes of _Democracy in America _, Tocqueville emerges from this collection as a vital interlocutor for democratic theorists confronting the power relations generated by intersections of gender, sexual, racial, class, ethnic, national, and colonial identities. Is there a link between how a firm manages its internal and external stakeholders? More specifically, are firms that give employees stock ownership and more say in running the enterprise more likely to engage with external stakeholders? This study seeks to answer these questions by elaborating on mechanisms that link employees to external stakeholders, such as the community, suppliers, and the environment. It tests these relationships using a sample of 347 private, mostly small-to-medium size firms, which completed a stakeholder impact (...) assessment organized by the non-profit B Lab. The results support the hypotheses that both employee ownership and employee involvement are positively associated with external stakeholder engagement. Further, we found that certification plays a role, as employee ownership contributes to external stakeholder engagement only in certified B Corporations, and not in firms that merely completed the B Lab Impact assessment. Our findings have import for stakeholder engagement frameworks, as we show that there is interplay between internal employee stakeholders and external stakeholders that may be important to overall firm–stakeholder management. According to Greenberg, most commentators have misunderstood Kant’s purpose and method in the Critique of Pure Reason, as well as his underlying ontology. To correct these errors, Greenberg defends four theses. First, Kant is concerned only with a priori and not empirical knowledge in the Critique. Second, Kant’s underlying ontology consists of a monism of “things.” Third, the table of the logical functions of judgement is not drawn from general logic, because these functions have a “content.” And fourth, the deduction (...) depends on a distinction between two concepts of relations corresponding to the German terms Verhaltnis and Beziehung. The distinction is important, however, since Kant argues that the subject’s B-relation to objects consists in certain V-relations among representations. Throughout, Greenberg targets Strawson’s dismissal of Kant’s idealism, as well as positions taken by Allison, Guyer, and Kitcher. Although I am sympathetic with some of his views, it is not always clear how much he actually diverges from the standard reading. (shrink)

Chicanas and Mexican women share a history of colonialism that has (a) sustained oppressive constructions of gender roles and sexuality, (b) produced and reproduced them as racially inferior and as able to be silenced, conquered, and dominated physically and mentally, and (c) contributed to the exploitation of their labor. Given that colonialism has also come to shape the way young women of Mexican heritage learn in mainstream US schools, informal education from everyday women's conviviality and solidarity becomes a pivotal context (...) in which they can learn how to reconstitute colonial legacies. We examine how a group of Mexican working-class immigrant women at home and in a sweatshop fashion a girl named Ana, the main character in the popular film Real Women Have Curves, into a confident young woman who engages in what Pérez (1999, 2003) refers to as empowering and dynamic decolonial ways of seeing, knowing, doing, being, and reconstituting. In spite of its contradictions that, at times, assist in reproducing Ana as an oppressed laborer, it is their doing that helps produce her as a woman who engages in decolonial practices by facilitating her to deftly negotiate an oppressive economic and patriarchal space, a mainstream feminist space, and a space where their embodiments and creative cultural discourse, practices, and beliefs shine. As such, the film provides a powerful counterstory (Delgado 1989) that disrupts the chokehold of the logic of colonialism and how it seeks to classify, stereotype, and control young women like Ana. This commentary builds on ongoing dialogs examining the impact agenda. Its purpose is to (a) demonstrate how pracademia can enhance the impact agenda of Business Schools and (b) apply principles from socio-technical theory, to show how achieving this requires widespread culture change in Business Schools, which must be considered within the wider socio-technical system in which pracademia and impact are embedded. We consider inherent problems, and ways forward.

We describe the ethical leadership dilemmas confronting Verdant Power. Formed in 2000, this New York City marine renewable energy company develops projects and technology that delivers electricity directly into the local power grid. Set in early 2010, the case outlines the tensions, challenges and costs (both financial and time) that management faces as it attempts to commercialize a technology in an industry with strict and rigid regulatory policies. The key teaching objectives of the case include a) understanding the leadership role (...) that the company must assume in paving the way for regulatory reform for US-based marine renewable technology ventures, and b) appreciating the importance and implications of sustainability given the pursuit of the financial and environmental mission of the founders. According to Frank, Plato's dialogues offer divergent approaches to literacy: while one method is rigidly top-down, the other promotes learners' independence. She argues that Plato endorses the latter view and that this lens on becoming literate is also the one he favors for our acquisition of knowledge, as well as for ethics and politics. Dismissing the idea that Plato's thought developed, Frank moves without comment from the Republic to works usually deemed to belong to different phases of Plato's writing, both (...) early and late. Because Frank's approach is nondoctrinal, in no dialogue is its main character properly seen as Plato's "mouthpiece".... (shrink)

Schmitt at the University of Padua on September 4-6, 2000, jointly co-sponsored by Padua's Department of Philosophy, the Centro per la Storia dell'Università di Padova, the Seminar für Philosophie und Geistesgeschichte der Renaissance of the University of Munich, the Center for Medieval and Renaissance Natural Philosophy of the Catholic University of Nijmegen, and the Foundation for Intellectual History of London. It was indeed Schmitt's merit (one thinks first and foremost of The Cambridge History of Renaissance Philosophy he edited in 1988) to have revised in the most critical and convincing way the image historians of philosophy had of Renaissance Aristotelianism as a backward-looking movement unable to express any vitality, to say nothing about its influence on later philosophers. Obviously, the Paduan Aristotelians did not achieve the same impact as Descartes and they did not produce the sharp reactions the libertins provoked. Yet, their impact was substantial, as many contributors show, with a concentration in the north of central Europe, i.e., in Germany and in Scandinavia.The volume opens with a paper by Stefano Perfetti on the physician, statesman, and philosopher Giulio Cesare Scaligero, who belongs among the Paduan Aristotelians because he received his education at Padua. The works of the "pure Aristotelian" (following the definition of this movement provided by Wilhelm Risse) Giacomo Zabarella, surely the most celebrated of the group, is the subject of papers by Francesco Bottin, Ian McLean, Sachicko Kusukawa, Daniel A. Di Liscia, Heikki Mikkeli, Merio Scattola, David A. Lines, Antonino Poppi, Paul Richard Blum, Giovanna Varani, Gregorio Piaia, and Giuseppe Micheli. They have looked into the impact of Zabarella's philosophy, logic, and theory of demonstration (the celebrated regressus) in contexts such as Lutheran Germany and Scandinavia, Reformed Germany and Holland, and Catholic Italy and France during the impressive span from the publication of Melanchthon's Dialectic in 1520 to that of Kant's Critique of Judgment in 1790. Less known today, but quite influential until 1648, was the "eclectic Aristotelian" (to use Schmitt's phrase) and colleague (and antagonist) of Zabarella, Francesco Piccolomini, whom Jill Kraye, Heikki Mikkeli, Merio Scattola, and David A. Lines consider in their papers. Piccolomini became famous for his mediation between Aristotelianism and Platonism. He revived "the soul of Aristotle and the spirit of Plato," as a contemporary said. Pierre Bayle and Jakob Brucker highlighted Piccolomini's efforts to combine Aristotelian and Platonic philosophy; and modern scholars have identified many [End Page 414] Platonizing elements in his Aristotelianism. In the hope of producing a more accurate and complete picture of eclectic Aristotelianism within the context of Renaissance moral philosophy, Jill Kraye's paper explores a neglected side of Piccolomini's ethical thought, namely his careful account of Stoicism. Finally, a group of papers with a more general scope needs to be mentioned, namely Heinrich C. Kuhn's survey of works of Paduan Aristotelians in German libraries, Charles H. Lohr's paper on the sources of Calvinist theories of science, and Ekhard Kessler's paper on the relation of logic to hermeneutics. As a last remark, of the seventeen contributions to this important volume, which no research library should be without, eight are in Italian, six in English, and three in German.
